These General Terms and Conditions (T&C) apply to all orders placed through the online shop emparo.ch. The contracting party is:

These T&C apply to all orders from consumers (B2C) — natural persons ordering goods for private purposes — as well as from businesses (B2B) — legal entities or sole proprietorships ordering within their commercial activity. Where rules differ between B2C and B2B, this is expressly indicated (see § 15). Deliveries are made exclusively within Switzerland.
The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to order (invitatio ad offerendum).
A click on the «Buy now» or «Complete order» button constitutes a binding order for the goods contained in the cart.
The contract of sale is concluded as soon as the order is accepted by means of an order confirmation by email. This confirmation is generally sent immediately after receipt of the order.
The right to refuse individual orders without stating reasons is reserved, in particular in case of obvious pricing errors or unavailable items.
All displayed prices are final prices in Swiss francs (CHF) and are inclusive of the statutory value-added tax (VAT). Shipping costs are shown separately and are visible during the order process before checkout.
Price changes are reserved at any time. The price valid at the time of the order is decisive.
Payment is processed through the payment service provider Stripe (Stripe Payments Europe Ltd., Dublin, Ireland). The following payment methods are available:
The invoice amount is due upon completion of the order. For Klarna, the T&C of Klarna apply additionally.
The right not to offer individual payment methods without stating reasons is reserved.
Deliveries are made exclusively to addresses within Switzerland. Delivery abroad is not possible.
The expected delivery time is indicated for each product. As a rule, delivery is made within 1–2 working days of receipt of payment. Different delivery times are indicated in the shop.
Current shipping costs are displayed during the order process before checkout. From an order value of CHF 75, delivery is free of charge.
The risk of accidental loss and accidental deterioration of the goods passes to the buyer upon handover to the transport person (Art. 185 CO).
Orders may be executed in partial deliveries to the extent reasonable. No additional shipping costs are incurred.
The delivered goods remain the property of House of Goods GmbH until full payment of the purchase price (Art. 715 CC).
Consumers are entitled to a 30-day exchange right. The goods may be returned without stating reasons within 30 days from the date of delivery, provided that the following conditions are met.
Return costs are borne by the consumer, unless the delivery was defective.
For an exchange, a voucher equivalent to the sale value of the goods (excluding shipping costs) is issued. Cash refunds or refunds to the original payment method are excluded.
The exchange right does not apply in particular to:
The statutory warranty rights under the Swiss Code of Obligations (Art. 197 et seq. CO) apply. The warranty period is 2 years from handover of the goods.
In case of a defect, the following rights may be claimed:
Defects must be reported without delay after discovery. Reports are sent to service@emparo.ch with a description and, if possible, photos of the defect.
Liability for damages caused by the seller, its legal representatives or vicarious agents exists only in case of intent or gross negligence.
Liability for slight negligence is excluded, provided that no essential contractual obligations are violated and no damages from violation of life, body or health are concerned.
All content of the online shop (texts, images, graphics, logos, product descriptions) is protected by copyright and is the property of House of Goods GmbH or the respective rights holders. Any use without express written consent is prohibited.
Information on the processing of personal data is provided in the privacy policy.
There is neither an obligation nor a willingness to participate in dispute resolution proceedings before a consumer arbitration body.

Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction for all disputes arising from or in connection with these T&C is Schlieren, Canton of Zurich, provided that the buyer does not have a general place of jurisdiction in Switzerland or transfers their domicile abroad after conclusion of the contract.
The following provisions apply exclusively to orders from businesses within the framework of their commercial or independent professional activity. In case of conflict, these B2B provisions prevail over the general provisions.
Business customers have no statutory right of withdrawal or exchange. Returns are only possible after prior written agreement and are assessed on a case-by-case basis.
Business customers are obliged to inspect the delivered goods immediately after receipt for defects (Art. 201 CO). Obvious defects must be notified in writing within 5 working days after delivery. For hidden defects, a notification period of 5 working days from discovery applies. Late notifications are deemed acceptance of the goods.
The warranty period for business customers is 1 year from the date of delivery, unless otherwise agreed in writing.
For business customers, the prices displayed in the shop, including VAT, generally apply. Individual conditions (e.g. quantity discounts, net prices) require a separate written agreement.
For business customers, payment by invoice with a payment period of 30 days net may be granted by written agreement. In case of late payment, interest on arrears in accordance with Art. 104 CO (5% p.a.) as well as any reminder fees are charged.
Towards business customers, liability is limited to foreseeable damage typical of the contract. Liability for indirect damages, lost profits and consequential damages is excluded to the extent permitted by law.
Resale of the acquired products is only permitted with the express written consent of House of Goods GmbH. In particular, the use of emparo's trademarks, logos and product images is subject to a separate license agreement.
Changes to these T&C are reserved at any time. The T&C valid at the time of the order are decisive. The current version is available on this page.
